NEW ROUTE TRAIL SOLUTIONS Terms and Conditions of Service Effective Date: April 2, 2026
Please read these Terms and Conditions (“Terms”) carefully before engaging New Route Trail Solutions (“Company,” “we,” “our,” or “us”) for any landscaping or trail maintenance services. By signing a service agreement, submitting a service request, or allowing work to commence on your property, you (“Client”) agree to be bound by these Terms.
1. Services
New Route Trail Solutions provides residential and commercial landscaping services, trail design and maintenance, and related outdoor property services as described in each project estimate or service agreement. The scope of work for any engagement will be detailed in a written estimate or proposal provided to the Client prior to commencement.
We reserve the right to decline, modify, or discontinue any service at our sole discretion. Services not explicitly listed in the agreed estimate are not included and may be quoted separately upon request.
2. Estimates and Pricing
All estimates are valid for thirty (30) days from the date of issue unless otherwise stated in writing. Estimates are based on information available at the time of assessment and are subject to change if conditions on-site differ materially from those observed during the initial consultation.
Final pricing may be adjusted for the following reasons:
- Discovery of underground utilities, drainage issues, or debris not visible during assessment
- Changes in material costs beyond the Company’s control
- Client-requested changes to the original scope of work
- Conditions requiring equipment or labour beyond what was initially anticipated
Any adjustments to the estimated price will be communicated to the Client in writing before additional work proceeds.
3. Payment Terms
Payment terms will be outlined in the project estimate or service agreement. Unless otherwise agreed in writing:
- A deposit of up to 50% of the total project cost may be required prior to commencement of work
- The remaining balance is due upon completion of the project
- Recurring service agreements are invoiced monthly and due within 15 days of invoice date
We accept payment by cheque, e-transfer, or credit card. Accounts unpaid after 30 days from the invoice due date may be subject to a late payment fee of 1.5% per month on the outstanding balance. The Client is responsible for any collection costs, including reasonable legal fees, incurred in recovering overdue amounts.
4. Scheduling and Access
The Client agrees to provide reasonable access to the property on agreed service dates. If access is denied or the site is inaccessible (including due to locked gates, dogs, parked vehicles, or other obstructions), a cancellation or trip fee may apply.
New Route Trail Solutions will make reasonable efforts to adhere to scheduled service dates. However, services may be rescheduled due to inclement weather, equipment failure, or other circumstances beyond our control. We will notify the Client as promptly as possible in such cases.
5. Client Responsibilities
The Client is responsible for:
- Disclosing the location of all underground utilities, irrigation systems, septic systems, and any other infrastructure prior to work commencing
- Informing the Company of any hazardous materials, chemical treatments, or conditions present on the property
- Ensuring the work area is clear of personal property, vehicles, pets, and other obstructions prior to each scheduled service
- Obtaining any necessary permits, HOA approvals, or municipal authorizations required for the work
New Route Trail Solutions will not be liable for damage to undisclosed or improperly marked utilities or underground infrastructure.
6. Liability and Limitation of Damages
New Route Trail Solutions carries general liability insurance. In the event of damage caused directly by our negligence, we will work with the Client to address the issue. Our liability is limited to the value of the services rendered under the applicable project agreement.
We are not liable for:
- Pre-existing conditions, diseases, pest infestations, or structural issues affecting plants, trees, or property
- Natural plant loss due to weather, drought, disease, or other environmental factors following service completion
- Damage resulting from the Client’s failure to disclose relevant site information
- Indirect, incidental, or consequential damages of any nature
7. Warranty
New Route Trail Solutions warrants that all services will be performed in a professional and workmanlike manner. If the Client is dissatisfied with the quality of work, they must notify us in writing within five (5) business days of service completion. We will assess the concern and, at our discretion, re-perform the applicable service at no additional charge.
No warranty is provided for plant material, sod, seed, or other living materials, as survival is subject to environmental conditions, Client maintenance, and factors outside our control unless a separate written warranty has been provided.
8. Cancellation Policy
Clients may cancel or reschedule a service appointment with at least 48 hours’ advance notice at no charge. Cancellations made less than 48 hours before the scheduled appointment may incur a cancellation fee equivalent to 25% of the estimated service cost.
For multi-phase projects, cancellation after work has commenced will require payment for all work completed to date, plus any material costs already incurred. Deposits are non-refundable unless the Company cancels the project.
9. Use of Subcontractors
New Route Trail Solutions may engage qualified subcontractors to perform portions of the work. All subcontractors are required to meet our standards of workmanship and are covered under applicable insurance requirements. The use of subcontractors does not alter our obligations to the Client under these Terms.
10. Environmental and Regulatory Compliance
New Route Trail Solutions conducts all operations in compliance with applicable federal, provincial, and municipal environmental regulations. The Client agrees not to request or require the Company to perform any work that would violate applicable law, including improper disposal of waste or use of restricted pesticides or herbicides.
11. Privacy
Any personal information collected in the course of providing services is used solely for the purposes of delivering and administering those services, processing payments, and communicating with the Client. We do not sell or share personal information with third parties except as required to deliver services or comply with legal obligations.
12. Dispute Resolution
In the event of a dispute arising from these Terms or any service agreement, the parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute may be referred to mediation prior to any legal proceeding.
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. Any legal proceedings shall be brought in the courts of British Columbia.
13. Amendments
New Route Trail Solutions reserves the right to update these Terms at any time. Updated Terms will be provided to Clients upon request or posted to our website. Continued engagement of our services following notice of updated Terms constitutes acceptance of the revised Terms.
14. Entire Agreement
These Terms, together with any signed service agreement or project estimate, constitute the entire agreement between the Client and New Route Trail Solutions with respect to the services described therein. They supersede all prior discussions, representations, or agreements, whether oral or written.
